Adah man wants to revisit preliminary hearing in homicide

May 29, 2009

The Herald Standard Reports:

By Jennifer Harr

Herald-Standard

Although one of the two people accused in the death of a newborn baby has backed out of a tentative plea deal, Fayette County District Attorney Nancy D. Vernon said his alleged co-conspirator will testify against him.

Vernon said Thursday that William Bircher, who initially agreed to plead guilty to third-degree murder in the death of the infant who became known as “Baby Mary,” indicated he no longer wished to do so.

With that, his attorney, Jack W. Connor, filed a motion to remand the case to the preliminary hearing stage. Bircher, 34, of Adah had waived that hearing last month when he agreed to the plea.

Vernon said she won’t oppose having a preliminary hearing if it does not count against the time prosecutors have to bring Bircher to trial.

A preliminary hearing determines if there is enough evidence to bind the case over to court.

He and the baby’s mother, Sarah Sue Hawk, 25, of Uniontown were charged with killing the baby between May 27 and June 4, 2000. State police alleged that the two put the newborn into a backpack, put it into a plastic bag, and placed it into Cove Run Creek in North Union Township.

Two men who were fishing in the area found it.
