Greene County woman resentenced for fatal crash

September 28, 2009

The Herald Standard Reports:

WAYNESBURG – Making what he called a “technical adjustment” to a prior sentence, Greene County President Judge William R. Nalitz Monday sentenced Britnee Nicole Moore to three years of intermediate punishment including at least five months incarceration in the Greene County Jail for the March 2007 homicide by vehicle death of Hope Katelynn Maley.
Nalitz had previously sentenced Moore to five to 36 months in the county prison, but a question arose regarding whether the state or county probation office would retain jurisdiction. Normally, the state probation office handles probation of cases in which people serve at least two years.
Nalitz ordered the hearing after he received word from the Pennsylvania Board of Probation and Parole that the agency believed it had parole authority over Moore because of the maximum sentence she received.
Part of the sentence included Moore completing 300 hours of community service once she was paroled, including speaking to students at each of the county’s five high schools about the hazards of cell phone use while driving.
Before issuing the sentence, Nalitz said that he felt there was a misunderstanding regarding which agency retained jurisdiction. Nalitz had intended for the Greene County Probation Office to maintain supervision over Moore when she received parole.
“I think I’m right and I think the parole board is wrong,” Nalitz said.
